fundation的捐贈不是法律強制的，spending rate達成5%，只是為了免稅，換言之，如果達不成5%，無非就是需要交稅。這個是舊考綱的說法。所以在舊考綱中，不會強制要捐5%。因此承擔風險的能力強，如果今年表現(xiàn)不好，可以少捐錢。
但新考綱中，對于fundation來說，legally required to spend 5% of assets，原話如下。
U.S. foundations are legally required to spend 5% of assets. Foundations should maintain sufficient liquidity to meet near-term spending, capital calls from private limited partnership fund investments.
